A team of lawyers of bpv Grigorescu, led by partners Liz Minea (Litigation) and Anca Parascan (Public Procurement), has obtained, on behalf of clients EvoBus Romania and BRD Sogelease, an irrevocable decision by the Ploiesti Court of Appeal allowing the two companies to enter into a public procurement contract with the Timisoara Transportation Company for delivery of 31 busses and coach-busses.
Timisoara Transportation Company initiated a public procurement procedure for the supply and maintenance of busses and coach-busses for an estimated value of €11.20 million.

The contract was awarded to the consortium EvoBus – BRD Sogelease, but the award was disputed by one of the unsuccessful bidders before the National Council for Solving Complaints (CNSC). CNSC upheld the claim of the unsuccessful bidder, however, in an irrevocable appeal decision rendered by the Ploiesti Court of Appeal, the award to EvoBus – BRD Sogelease was deemed compliant with the applicable public procurement regulations.

“We are very glad that after a long battle, involving complex subject matter and procedural aspects, including a relocation of court jurisdiction from Timisoara to Ploiesti, our team has secured this victory for our clients, who can now focus, together with the public partner, on the contract and its proper implementation ”, said Liz Minea (photo).

Public procurement is one of the main practice areas of bpv GRIGORESCU. The fees earned in the financial year 2009 in connection with public procurement projects to approximately 16.5 percent of the firm’s total revenues.

EvoBus Romania is a wholly-owned subsidary of EvoBus GmbH, the largest affiliate of Daimler AG in Europe, and the largest bus and coach-bus manufacturer.
